Who is covered under Myrtle Beach Worker’s Compensation Law?
Cases can be denied because of workers compensation coverage issues. Every South Carolina employer and employee is presumed to be covered by the South Carolina Worker’s Compensation Act, with a few exceptions:
- Railroad companies and employees
- “casual” employees
- Federal employees in South Carolina
- Business with less than 4 employees
- Agricultural Employees
- Independent Contractors
- Certain Real Estate Salespersons
Employers are required to maintain insurance sufficient for the payment of compensation, or they shall furnish to the Worker’s Compensation Commission satisfactory proof of the companies ability to pay the compensation in the amount and manner due to an injured employee. The South Carolina Department of Insurance is responsible for approving the rate and classification for all worker’s compensation insurers. The Commission is responsible for approving the rate and classification for all individual and group self-insurers.
